Binding agreement. By creating an account, purchasing from the marketplace, or otherwise using WhispSocio you agree to these Terms and Conditions. If you do not accept them, do not access or use the platform.
Company. These terms are between you and WhispSocio, LLC, a company incorporated in United Kingdom.
Terms overview
These WhispSocio Terms and Conditions set the rules for using our social platform, live streams, marketplace, creator subscriptions, virtual Coins, gifts, Cash Earnings, and paid features. They explain what users, streamers, creators, buyers, and sellers can expect from WhispSocio and what we expect from them.
- Accounts and safety: keep your details accurate, protect your login, follow community rules, and do not misuse the platform.
- Content and live streaming: you keep ownership of your content. WhispSocio does not own user posts, photos, videos, streams, comments, messages, listings, or other user-created material.
- Marketplace and paid features: sellers and creators must describe offers accurately, honour consumer rights, and accept applicable platform fees.
- Coins and Cash Earnings: Coins are digital feature balance and are not cash; eligible earnings are handled through separate Cash Earnings and payout rules.
- Refunds and moderation: users keep statutory rights, and WhispSocio may restrict content, listings, streams, or accounts that break these terms.

We operate a global social platform with profiles, posts, comments, follows, messages, live streams, stream battles, virtual gifts, XP rewards, creator subscriptions, events, personalised recommendations, analytics, and a marketplace for physical and digital items. References to "we", "us" or "our" mean WhispSocio, LLC. References to "you" or "your" mean the individual using the service or, where relevant, the business they represent.
2. Using WhispSocio
2.1 Eligibility
- You must be at least 13 years old to create an account, unless the law where you live requires a higher minimum age for social media or similar online services. Where local law requires us to prevent users under 16 from holding accounts or using social-media features, including Australia and any UK rules once they take effect, you must be 16 or older to use those parts of WhispSocio.
- If you are 13-17 and allowed to use WhispSocio in your location, you confirm you have consent from a parent or legal guardian and must not use adult, seller, payout, gambling-style promotion, age-restricted, livestreaming, stranger-contact, or other restricted features unless those features are lawful for your age and enabled for you. Where livestreaming is not lawful for under-18 users in your region, WhispSocio may disable stream creation and broadcast controls until you meet the applicable age requirement.
- You must provide accurate registration details and keep them up to date.
- We may ask for age assurance, parental or guardian confirmation, or other checks where required by law, platform safety rules, payment rules, or feature restrictions. We may suspend, restrict, or close accounts where age information appears inaccurate or where a user is below the permitted age for their region.
- One personal account is permitted per individual. Business and creator accounts must be authorised for the organisation they represent.
2.2 Account security
- Keep your login credentials confidential and use a strong, unique password.
- Enable two-factor authentication (2FA) in account settings where available.
- Notify us immediately at security@whispsocio.com if you suspect unauthorised use. You are responsible for activity carried out under your account until you inform us.
- We may suspend or close accounts that are compromised, inactive for an extended period, or in breach of these terms.
2.3 Platform standards
You agree to use WhispSocio lawfully and respectfully. In particular you must not:
- Upload, stream, or sell anything illegal, infringing, or harmful.
- Harass, threaten, defame, or abuse others.
- Attempt to reverse engineer, interfere with, or disrupt the platform or its security features.
- Use automated tools (bots, scrapers) without written permission.
- Collect personal information from other users without a lawful basis.
2.4 Personalized recommendations
WhispSocio uses algorithms to rank and suggest posts, events, pages, marketplace listings, and other content. Recommendations are based on factors such as your declared interests, activity on the platform (for example views, likes, comments, follows, RSVPs, and purchases), profile location, and general popularity or recency of content.
- Recommendations are provided to improve relevance and discovery. They are not guarantees of quality, safety, or suitability of third-party content or sellers.
- You can adjust declared interests in account settings and, where offered, choose non-recommended sorts (for example newest listings).
- We may change recommendation logic, weighting, or features over time as the platform evolves.
- Recommendations do not replace your responsibility to review listings, events, streams, and user-generated content before participating or purchasing.

3. User content & community conduct
3.1 Ownership and limited platform licence
Your content stays yours. You retain all ownership and intellectual property rights in the content you create, upload, post, stream, sell, send, or otherwise share on WhispSocio. Posting content on WhispSocio does not transfer ownership to us.
When you add content to WhispSocio, you give us only the limited permission needed to run the service: to host, store, back up, process, transcode, resize, preview, display, transmit, and make that content available to the audience you choose through your privacy settings, purchases, subscriptions, stream access, marketplace listing visibility, or other feature settings. This permission is non-exclusive, worldwide, royalty-free, and exists only so WhispSocio can provide the features you use, maintain security, enforce these terms, comply with law, and handle support, moderation, disputes, backups, and deletion requests.
We do not claim ownership of your content. We will not use your posts, photos, videos, streams, comments, messages, marketplace listings, or other user-created material in WhispSocio advertising, external marketing campaigns, sponsored content, product demos, promotional material, or AI/model training unless you give us separate, clear permission for that specific use. We will not sell, license, or otherwise monetise your content outside the platform without your express permission.
If a separate creator, marketplace, sponsorship, promotion, or paid collaboration agreement applies, we will show the specific rights, payment terms, and permissions for that agreement before you accept it. Nothing in these Terms gives WhispSocio a blanket right to reuse your content for advertising or commercial promotion without asking you first.
The limited platform permission ends when your content is deleted from WhispSocio, except where copies remain in backups for a reasonable period, where other users have already interacted with or shared content in ways the platform allowed before deletion, or where retention is required for legal, safety, accounting, fraud prevention, moderation, dispute, or enforcement reasons.
3.2 Prohibited content
We remove or restrict content, broadcasts, messages, listings, usernames, profile details, stream thumbnails, and uploaded media that:
- Is unlawful (including terrorism, child sexual abuse material, or the sale of prohibited goods).
- Incites hatred or discrimination, promotes self-harm, or glorifies violence.
- Contains nudity or sexually explicit material inconsistent with our community standards.
- Infringes third-party intellectual property rights.
- Constitutes spam, scams, fake engagement, impersonation, phishing, or deceptive behaviour.
- Offers prohibited, unsafe, counterfeit, recalled, regulated, or age-restricted goods unless clearly allowed by law and by our marketplace rules.
3.3 Moderation
We combine automated detection with human review to enforce these standards and meet online safety expectations in the UK, EU, and other regions where they apply. Users can report content, accounts, listings, streams, messages, or suspected illegal activity through on-site tools or via report@whispsocio.com. We aim to review most reports within 48 hours, prioritising child safety, terrorism, fraud, credible threats, self-harm risk, and other urgent safety issues.
Moderation actions may include labels, reduced visibility, age gating, removal, stream interruption, account restrictions, seller restrictions, suspension, or referral to law enforcement where required. You may appeal moderation outcomes by emailing appeals@whispsocio.com within 14 days. Appeals are assessed by a reviewer not involved in the original decision wherever practical.
3.4 Intellectual property notices
If you believe content infringes your rights, email ip@whispsocio.com with the details required under UK notice-and-takedown law. We may share your notice with the user who posted the content. Repeat infringers may be suspended or banned.
3.5 Live streaming, battles & viewer features
- You are responsible for everything you broadcast, including your camera, screen share, microphone, stream title, thumbnail, overlays, chat, and invited battle guests.
- You must not stream private spaces, private conversations, copyrighted material, regulated activities, dangerous acts, or anyone who has not consented where consent is legally required.
- Viewers may see live thumbnails, previews, playback controls, chat, pause/resume state, and stream-ended notices. Technical delays can occur and a stream marked "live" may not be perfectly real time for every viewer.
- Battle invites, requests to join, co-streams, and similar collaboration tools must not be used to harass, pressure, or mislead other users.
- We may record technical stream metadata, thumbnails, reports, and limited diagnostics to operate the service, investigate abuse, and improve reliability. We do not promise to store full live streams unless a replay or VOD feature is clearly offered.
4. Marketplace, sellers & paid creator features
4.1 Buying on WhispSocio
- When you purchase from a seller you enter into a contract with that seller. WhispSocio facilitates the transaction and provides buyer protection as set out in these terms.
- Prices are displayed in pounds sterling (GBP) unless otherwise stated. Taxes and delivery charges are shown before you confirm payment.
- You must ensure delivery details are correct. Buyers are responsible for customs duties or import taxes where applicable.
4.2 Selling on WhispSocio
- Sellers must be 18+ and complete our verification steps, including proof of identity and payout details.
- All listings must accurately describe the item or service, including pricing, availability, and any material conditions.
- Business sellers must provide legally required identity and contact information, comply with tax obligations, and make clear whether a listing is sold by a business or an individual.
- Sellers must comply with consumer protection legislation, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
- Orders should be dispatched within the timeframe stated in the listing. Keep proof of postage or delivery.
- Sellers must handle returns fairly and respond to buyer messages within a reasonable time (48 hours wherever possible).
- We may deduct marketplace commission, payment provider costs, refund/chargeback amounts, and payout processing fees from seller payouts. Current fee structures are shown on our Fees page, seller pages, listing pages, and payout pages where available.
4.3 Prohibited and restricted listings
You must not list items or services that are illegal, unsafe, counterfeit, infringing, misleading, stolen, recalled, age-restricted without lawful age checks, or otherwise prohibited by our policies. This includes weapons, controlled substances, exploitative content, stolen digital accounts, fraudulent documents, and goods that breach sanctions or export controls.
4.4 Platform's role
WhispSocio provides the marketplace infrastructure, payment facilitation, and support escalation. We are not the seller of third-party goods or services. We may intervene to mediate disputes, hold funds in escrow or pending wallet balances, delay or reverse payouts, and issue refunds to protect buyers when a seller fails to meet their obligations. Sellers, creators, and eligible streamers receiving Cash Earnings must also accept our Cash Earnings & Payout Terms, which explain how wallet balances, holds, and withdrawals work.
4.5 Creator subscriptions, memberships & paid access
- Creator subscriptions or memberships give access to the benefits shown at checkout, such as supporter content, profile benefits, or community features.
- Creators are responsible for delivering promised benefits and keeping descriptions accurate. We may remove, refund, or restrict paid access that is misleading, unsafe, or unlawful.
- Recurring paid access renews until cancelled. You can cancel future renewals in your account or by contacting support. Cancellation does not normally refund a period that has already started unless the service was faulty, unavailable, or misdescribed.
- WhispSocio currently retains 1% from creator subscriptions; creators receive 99% before payment provider, tax, refund, chargeback, or payout adjustments.
- Creators must not promise financial returns, gambling outcomes, regulated advice, medical claims, or unlawful rewards through paid access.
5. Payments, fees, coins & refunds
5.1 Payments
- Card payments are processed securely by Stripe Payments Europe, Limited or its affiliates. Stripe's terms may apply in addition to these terms.
- We may offer additional payment methods (for example, bank transfer or PayPal) which will be subject to their own terms.
- Virtual currency ("Coins") can be purchased in-app. The price and any promotional bonuses are displayed at the point of purchase.
5.2 Fees and commission disclosure
- Creating an account, posting, browsing, following, commenting, applying to become a seller, and listing marketplace items are free unless a paid feature clearly says otherwise.
- Buyers do not currently pay a separate WhispSocio buyer service fee for ordinary marketplace purchases. Buyers pay the item price, delivery charge, taxes, import duties, and any payment or currency conversion charges shown by the payment provider or bank.
- Physical marketplace sellers currently pay 10% commission for individual seller accounts and 7% commission for business seller accounts.
- Profile cosmetics marketplace sales currently have a 10% platform fee.
- Live stream and battle gift payouts currently have a 20% platform fee where those gift payouts are available. Gift payouts are credited as real-money Cash Earnings, not withdrawable Coins.
- Seller payout processing may carry a 2% payout processing fee depending on payout method and account setup.
- You can request a payout only when your available Cash Earnings balance is at least GBP 100.00, or the equivalent shown in your selected display currency where available. We may raise the minimum payout threshold, but it will not be set below GBP 100.00.
- Current fees are summarised on our Fees page and should also be shown at the relevant point before listing, subscribing, buying coins, sending gifts, or requesting a payout.
5.3 Virtual currency
- Coins are a limited, non-transferable licence to use specific digital features on WhispSocio. They are not redeemable for cash.
- Coins expire if your account is closed. We may adjust coin bundles or pricing with reasonable notice.
- Purchases of digital content and coins are generally non-refundable once delivered and used, except where required by law (for example, where the content is faulty, unavailable, or misdescribed).
5.4 Refunds & chargebacks
- You have statutory rights to a refund for faulty goods, misleading descriptions, or where a seller fails to deliver.
- Physical goods purchased from UK sellers qualify for a 14-day cooling-off period under the Consumer Contracts Regulations, unless an exemption applies (for example bespoke or perishable items). Inform the seller and us within 14 days of delivery to exercise this right.
- Services and digital content may be provided immediately if you expressly request early supply and acknowledge that your cancellation right may be lost once delivery starts or the digital item is made available, depending on the type of content and your local law.
- If you dispute a charge with your payment provider, we may suspend your account pending investigation.
5.5 Live streams, gifts, battles & promotions
- Virtual gifts, stream tips, and battle features use Coins or inventory items as displayed in the product. Coins are digital balance for users. Where a gift payout is available for a streamer, we calculate the gift's real-money value, deduct the platform fee, and credit the streamer's Cash Earnings wallet.
- Streamers are responsible for their broadcasts and must comply with content rules. WhispSocio may remove streams or restrict features for policy violations.
- Promotions, competitions, giveaways, prize draws, or lottery-style features (where offered) have separate rules shown at entry. Eligibility, prizes, free-entry routes, closing dates, and odds (if applicable) are described on the promotion page. We may restrict these features by age or location.
- Marketplace escrow or dispute holds (where enabled) are used to protect buyers and sellers; release timelines depend on delivery confirmation and dispute outcomes. Detailed wallet, escrow, payout, chargeback, and withdrawal rules are set out in our Cash Earnings & Payout Terms.
5.6 Cash Earnings, wallet balances & payouts
If you sell on the marketplace, receive creator subscription earnings, receive eligible stream gift payouts, or otherwise earn real-money Cash Earnings on WhispSocio, the following also applies in addition to section 5.2:
- Cash Earnings are shown as pending or available balances in your account. Pending balances are not withdrawable until release conditions are met.
- Cash Earnings are a contractual wallet entitlement operated by WhispSocio. They are not a bank account, deposit, or e-money product unless we expressly state otherwise in writing.
- We may hold, delay, offset, or reverse Cash Earnings for disputes, refunds, chargebacks, fraud reviews, compliance checks, policy breaches, or legal obligations.
- Withdrawals are subject to minimum balance thresholds, verified payout methods, processing times, and fees shown on our Fees page and payout screens.
- You must accept the current version of our Cash Earnings & Payout Terms before receiving payouts or operating paid earning features.
- You are responsible for your own tax reporting on Cash Earnings. WhispSocio does not provide tax advice.
6. Consumer information
- Pre-contract information. Key details about the seller, pricing, delivery, and cancellation rights are presented before you place an order.
- Receipts and invoices. You will receive email confirmation after purchase. Sellers are responsible for providing VAT invoices where required.
- Records. We recommend you download or print a copy of these terms and any order confirmations for future reference.
- Statutory rights. Nothing in these terms removes your statutory rights for faulty, misdescribed, unsafe, or undelivered goods, services, or digital content.
- Distance purchases. If you buy physical goods online from a UK business seller, you usually have 14 days after delivery to cancel and a further 14 days to return the goods, unless an exemption applies.
- Digital content. Digital items, subscriptions, coins, gifts, and paid access may have different cancellation rules once supply begins. We will show key information before purchase wherever the feature supports it.
7. Liability & legal terms
7.1 Service availability
We aim to keep WhispSocio available and secure but do not guarantee uninterrupted access. Scheduled maintenance, updates, or events outside our control (for example, internet outages) may affect availability.
7.2 What we do not exclude
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under UK law.
7.3 What we can limit
- We are not responsible for losses that are not reasonably foreseeable when you agree to these terms.
- We are not liable for business losses, including loss of profit, revenue, goodwill, or business interruption.
- For paid services provided directly by us, our total liability is limited to the fees you have paid to us in the 12 months before the event giving rise to the claim.
- We are not liable for the actions of other users or third-party services (including sellers, payment processors, and linked sites).
7.4 Indemnity
You agree to reimburse us for losses arising out of your breach of these terms, unlawful conduct, or infringement of third-party rights, except to the extent those losses result from our own negligence or misconduct.
8. Suspension & termination
- We may suspend or terminate your access if you materially breach these terms, create risk or legal exposure for us, or fail to pay sums due.
- We will normally notify you before suspension, explaining the reasons and how to appeal, unless notice would prejudice an investigation or violate the law.
- You may close your account at any time in the settings menu. Account deletion triggers a 30-day grace period before permanent deletion, during which you can reactivate.
- We may retain certain information after closure where required for legal, regulatory, or auditing purposes.
8.1 Safety reporting transparency
Where required by law, we may keep records of moderation decisions, illegal-content reports, seller verification, appeal outcomes, and safety risk assessments. We may publish transparency information about reports and actions taken, using aggregated or anonymised data wherever possible.
9. Resolving disputes
- Contact us first. Email disputes@whispsocio.com with a summary of the issue.
- Mediation. We may propose mediation with an independent Alternative Dispute Resolution (ADR) provider. If you are a consumer, we will provide ADR details upon request.
- Courts. These terms are governed by the law of England and Wales. You and we submit to the exclusive jurisdiction of the courts of England and Wales, except that consumers resident in Scotland or Northern Ireland may bring proceedings in their home jurisdiction.
10. Updates & versioning
- We may update these terms to reflect legal, regulatory, or operational changes.
- Material changes will be notified at least 30 days in advance via email or on-site notice. Continued use after the effective date constitutes acceptance.
- Minor edits (for example clarifications or corrections) take effect immediately upon publication.
11. Regional variations
WhispSocio is operated from the United Kingdom. We comply with UK law and honour mandatory consumer protections in the regions where our users are located. The following additional terms apply where required:
