Cash Earnings & Payout Terms

Who must accept these terms. You must read and accept these terms before earning Cash Earnings on WhispSocio, requesting a payout, or operating as a seller, creator, or eligible streamer receiving real-money payouts.
Not legal advice. These terms set out the contractual relationship between you and WHISPSOCIO LTD regarding wallet balances and payouts. They do not replace independent legal or tax advice.

1. Scope & acceptance
These Cash Earnings & Payout Terms ("Payout Terms") are a binding agreement between you and WHISPSOCIO LTD (Company No. 16817482) ("WhispSocio", "we", "us") governing:
- marketplace seller earnings;
- creator subscription earnings;
- live stream or battle gift payouts where available;
- profile cosmetics marketplace designer earnings; and
- any other real-money Cash Earnings balance shown in your account.
By applying to sell, enabling paid creator features, receiving gift payouts, viewing a Cash Earnings balance, or requesting a withdrawal, you confirm that you have read, understood, and agree to these Payout Terms and our main Terms and Conditions. If you do not agree, do not use payout features.
We record the version accepted and the date of acceptance. If we publish a material update, we may require you to accept the new version before making further withdrawals.
2. Definitions
- Cash Earnings means the real-money amount credited to your WhispSocio wallet after applicable platform fees, refunds, chargebacks, taxes shown at checkout, and adjustments, expressed in GBP unless another display currency is shown for convenience.
- Pending balance means Cash Earnings that have been credited but are not yet available for withdrawal, usually because delivery, dispute, fraud, or compliance checks are outstanding.
- Available balance means Cash Earnings that appear as withdrawable in your wallet, subject to minimum payout thresholds and these Payout Terms.
- Escrow / hold means a temporary restriction on some or all of your Cash Earnings while we assess an order, dispute, refund, chargeback, fraud concern, legal request, or policy review.
- Payout means a transfer of available Cash Earnings from WhispSocio to a payout method you have verified, such as PayPal, bank transfer, or another supported method.
- Coins are virtual digital balance used for certain site features. Coins are not Cash Earnings and are not withdrawable as cash unless a feature clearly states otherwise before you use it.
3. Nature of Cash Earnings
- Your wallet balance is a contractual entitlement recorded on WhispSocio. It is not a bank account, deposit, e-money account, or regulated payment account unless we expressly state otherwise in writing.
- WhispSocio does not pay interest on Cash Earnings.
- Displaying a balance in another currency is for convenience only. Payout calculations and minimum thresholds are based on GBP unless we clearly state otherwise at withdrawal.
- We act as a commercial agent and marketplace facilitator in collecting buyer payments and settling amounts owed to sellers, creators, and eligible streamers, subject to these terms and applicable law.
- Buyer payments for marketplace items are contracts between buyer and seller. WhispSocio facilitates payment collection, escrow or hold mechanics, dispute handling, and payout processing.
4. How payments flow
- A buyer or supporter pays WhispSocio or our payment processor (for example Stripe or PayPal).
- We calculate the net Cash Earnings owed to you after platform fees, promotions, taxes shown at checkout, and other disclosed deductions.
- The net amount is credited to your wallet, usually first as pending and later as available when release conditions are met.
- You may request withdrawal of available Cash Earnings that meet the minimum threshold through a verified payout method.
- We process payouts within the timelines shown in your dashboard, subject to fraud checks, banking hours, payment-provider rules, and these Payout Terms.
We may change payout providers, verification steps, or supported payout methods with reasonable notice where practicable.
5. Pending & available balances
5.1 Pending balance
Pending Cash Earnings are not withdrawable. Common reasons funds remain pending include:
- marketplace orders awaiting dispatch, delivery confirmation, or completion of the buyer-protection window;
- open buyer disputes, refund requests, or return processes;
- suspected fraud, policy violations, or abnormal transaction patterns;
- identity, tax, or compliance verification requirements; and
- chargeback or payment-processor investigations affecting the underlying transaction.
5.2 Release to available balance
We release pending Cash Earnings to your available balance when the underlying transaction is complete, the applicable hold period has ended, and no dispute, refund, chargeback, or compliance block applies. Release timing may vary by product type, seller history, and risk profile.
5.3 No guaranteed timeline
Timelines shown in the product (for example "awaiting delivery confirmation") are estimates only. We may extend holds where reasonably necessary to protect buyers, comply with law, or investigate abuse.
6. Withdrawals, minimums & fees
- You may request a payout only when your available Cash Earnings are at least GBP 100.00, or the equivalent shown in your selected display currency where available. We may raise the minimum threshold with notice, but not below GBP 100.00.
- Payout processing may incur a fee of up to 3%, depending on payout method and account setup, as shown on our Fees page and at withdrawal.
- You must provide accurate, verified payout details. We are not responsible for losses caused by incorrect payout information supplied by you.
- We may refuse, delay, split, or cancel a payout request if verification is incomplete, fraud is suspected, a hold applies, or we are required to do so by law or a payment provider.
- Processing times vary by method. PayPal, card, bank transfer, and manual payouts may take between 1 and 7 business days or longer in exceptional cases.
- Once a payout is marked completed, recall may not be possible. You are responsible for confirming payout destination details before submitting a request.
7. Holds, reversals, chargebacks & negative balances
- We may place a hold on pending or available Cash Earnings where we reasonably believe a refund, chargeback, dispute, fraud, legal obligation, sanctions issue, or policy breach may require it.
- If a buyer receives a refund, a payment is reversed, or a chargeback is upheld, we may deduct the refunded amount, associated fees, and reasonable investigation costs from your pending balance, available balance, or future earnings.
- If deductions exceed your current balance, your wallet may show a negative balance. You must repay any negative balance promptly on request. We may recover negative balances from future earnings or pursue other lawful recovery methods.
- We may offset amounts owed to us (including fees, chargebacks, penalties, or costs of investigation) against Cash Earnings before payout.
- Repeated chargebacks, fraud indicators, or policy violations may lead to suspension, delayed payouts, or permanent withholding of future earnings as permitted by law and our main Terms.
8. Account suspension, closure & remaining balances
- If your account, seller account, or paid features are suspended, restricted, or terminated, we may hold Cash Earnings while we investigate suspected breach, fraud, legal obligations, or buyer-protection claims.
- On account closure, any remaining available Cash Earnings may be paid out after lawful deductions, holds, disputes, and verification checks, provided no prohibition applies. Minimum payout rules may still apply.
- We may retain records of wallet transactions, payout requests, and identity verification for up to seven years for tax, audit, fraud-prevention, and legal reasons.
- Coins, XP, virtual items, and non-cash balances are handled under the main Terms and are not converted to Cash Earnings on closure unless expressly stated.
9. Tax, identity & compliance
- You are solely responsible for reporting and paying any taxes due on your Cash Earnings in your country of residence or business.
- We may request identity verification, proof of address, business registration, tax information, or source-of-funds documentation before releasing holds or processing payouts.
- We may withhold or delay payouts where required by anti-money-laundering, sanctions, fraud-prevention, or court orders.
- We may provide transaction summaries or reports where required by law, but we do not provide tax advice.
10. Insolvency & safeguarding
Cash Earnings are contractual rights against WhispSocio, not segregated client money in a bank account in your name. Except where we expressly state otherwise in writing or where mandatory law requires safeguarding, wallet balances are not protected by the Financial Services Compensation Scheme or equivalent deposit-protection schemes. In insolvency, you may rank as an unsecured creditor for unpaid Cash Earnings. We operate wallet balances in accordance with these Payout Terms and applicable law.
11. Liability & governing law
- Nothing in these Payout Terms excludes liability that cannot be excluded under UK law, including for death or personal injury caused by negligence or for fraud.
- Subject to mandatory law, WhispSocio is not liable for losses caused by payment-provider outages, bank delays, incorrect payout details supplied by you, buyer chargebacks, or events outside our reasonable control.
- These Payout Terms are governed by the laws of England and Wales. Courts in England and Wales have exclusive jurisdiction, except that consumers resident in Scotland or Northern Ireland may bring proceedings in their home jurisdiction.
- If any part of these Payout Terms is invalid, the remainder continues in effect.
12. Changes
We may update these Payout Terms to reflect legal, regulatory, payment-provider, or operational changes. Material changes will be notified in advance where reasonably practicable. Continued use of Cash Earnings features after the effective date constitutes acceptance, and we may require re-acceptance before further withdrawals.
